ASB. The Constitution expressly forbids any ex post facto laws of any kind. Period. End of Story.
It's very unlikely there were enough votes to amend the Constitution in any event, but if there were going to be any constitutional amendments inspired by McCarthyism it would more likely be to the Fifth Amendment's right against self-incrimination, a much more unpopular provision than the ex post facto clause.
