I explained in the second post that Cruz got the AG appointment over Mukasey, that's one of the PoDs for this.

Basically Cruz never was appointed Texas Solicitor General by Greg Abbott in 2003, hence he stayed in the Bush admin and got himself the nod to replace Gonzales in 2007.
