In 1937, FDR attempted to pass the Judicial Procedures Reform Bill of 1937. As the constitution did not give any specific size to the Supreme Court, FDR had a chance to expand the court from 9 (usually 5-4 against the New Deal) to 15 (with 6 new sympathetic members). Associate Justice Owen Roberts started playing ball in Roosevelt's court more and the bill was dropped.
