WI Diplomatic Immunity Never Existed As A Concept!

There was an incident where I live, a few years ago, where a young woman was raped and the rapist, a son of a diplomat claimed diplomatic immunity - How insane is that? What if it never existed as a concept at all?

Someone would come up with it. Really, some of these WIs these days are idiotic. Why would a foreign representative of a Great Power be held accountable to the laws of a lesser power especially when if its a non-Western country? "Unequal laws" are called those for a reason. The strong do as they wish and the weak suffer as they must - in diplomacy as in life.
 
Without diplomatic immunity, there would be no diplomacy. The concept is essential to ensure that ambassadors/diplomats can do their jobs in a foreign (sometime quite alien, actually) place without fearing for their lives. Informally, at least, it well predates the modern era.

Is diplomatic immunity misused? Absolutely. Is the answer getting rid of it? absolutely not.
 
Also, if memory serves, Diplomatic Immunity is immunity from the laws of the host country, not the law in general.

Which is to say, theoretically, the guy and other such are still guilty of breaking the law of their own country.
 
Not to mention that diplomatic immunity can be waived and has been when there was convincing evidence that the diplomat is guilty of a major crime. And if immunity sticks, the host country can always just Persona Non Grata the accused.
 
The origin of diplomatic immunity is simply 'I won't kill the guys you send to talk to me.'

If it somehow doesn't develop, you'd see diplomats being sent to neutral countries to transact their business with diplomats from the other countries there. Maybe even a quasi-UN develops if there is one neutral location where most diplomats end up getting sent.
