WI: Casey Anthony Jury deadlocks on Manslaughter Charge

On July 5th, 2011, Casey Anthony was acquitted of the crimes of first degree murder, Aggravated Child Abuse, and Aggravated Manslaughter of a child upon her daughter, Caylee Anthony. She was convicted of four counts of lying to investigators. The jury originally deadlocked 6-6 on the charge of Aggravated Manslaughter of a child, but decided to acquit her on this charge as well. What if the jury had remained deadlocked on this charge? Would Casey Anthony be retried on this charge?

If Retried, would she be convicted or acquitted? Would there be another hung jury? If convicted, what would her prison sentence be?
 
Like a lot of people I spend too much time watching the Casey Anthony Circus. You could not make a lot of this stuff up. The Schizophrenic mother. The bi polar mother. The father who may or may not be a child molester. The basically incompetent defense attorney. Then let’s not forget the bail bondsman who was going to get the story out of her; the search group; Dr. Vass from the body farm;. They were all there.

It is common for the prosecution to overcharge the defendant seeking leverage in plea negotiations. Murder requires intent and premedication. The also had a felony murder charge; which is a death that occurs during the commission of another crime; in this case aggravated child abuse; which also requires intent. The jury got it right on the murder charges; the prosecution had no evidence of intent.

As to the manslaughter charge I sort of doubt there would have been a retrial. It would cost the state too much. If there were a retrial I think the prosecution would have presented a streamlined case. Forget the body farm for one. For the defense I really thought that Baez may have gotten his client the death penalty. Rule 1 in any trial is do not promise more than you can deliver. Baez presented no evidence of child abuse by George and indeed the only way I think he could get there would be to have his client testify. Casey was either delusional or a pathological liar; neither a good thing in your star witness. Then be claims Caylee drowned in the swimming pool and George took the body. There really was nothing on this either save the one wacko woman who claimed a relationship with George and said George said “This just got all out of control.” I certainly would forget this tale in a retrial; of course I would never have gone there in the first place.

The Casey Antony case was OJ Simpson case 21st century. The prosecutor and police thought (correctly IMO) that they had their man/mom. For that reason the did not present the best evidence that they could have have and they did not do a sufficiently good job covering g the gaps in the evidence they did present,

I think if the jury had deadlocked on the Manslaughter charge, there most certainly would have been a retrial on that charge. The public would have demanded it, especially because Casey Anthony was Acquitted of the murder and child abuse charges, and also a retrial on the Manslaughter charge would have been shorter than the first trial.
 
What if she got it anyway?
The sentence can't be given. The law outlines what penalties can be applied for each offense. Penalty in excess is not legal.

If the jury tries, doubtful, and the judge let's it through, ASB levels of improbable, then it gets thrown out literally the second the defense appeals.
 
Unless someone goes Jack Ruby on her before the trial, that doesn't work. No court in America gives the death penalty for manslaughter.

That said, if she's tried in a second trial, she probably gets convicted and may plead to a charge less than that.

Depends on if she pleads to a lesser charge. These things get kicked down the road a hell of a lot, so it could be pushed out for a couple of years of there's no plea. Then we would see a lesser media circus and a trial that's maybe two-thirds as long since there's only one charge.

Would Casey Anthony have the same lawyers in her retrial? Or would she have new lawyers? Also, would there be a different prosecutor in the retrial?

I'm sure there would be a new prosecutor but her own legal team may stick around unless she's indigent and has to go with a public defender or something.
