But language in the Declaration of Independence in 1776 and legal requirements in the Constituion in 1787 - or in the appopriate acts for the Old Northwest and Old Southwest territories - are different things, and being offered and dealt with in vastly different geostrategic and political environments.

Jefferson tried to include a clause condemning--not even banning--slavery in the Declaration of Independence, but that still had to be edited out for the southern delegates. There is no way that banning slavery will fly.
