What would Mussolini have been convicted of if he survived WW2?

  • being on the loosing side
  • taking a nation not ready for war into war to fight a war alongside the Nazis
  • crimes against stupidity and logic
  • supporting the Nazis
  • being friends with Hitler
  • conceding to demands to turn over jews for extermination
  • taking a decently proud nation and turning it into a laughing stock of military jokes for the next 50 years.
  • being a pompous asshole..
  • I could go on you know .. but I will stop here.

What I think, yes. If Mussolini didn't killed, he would still be convicted for aligning with Hitler and also helped out to deport Jews from Italy. He might get executed around 1948.

I suspect he would be convicted of waging aggressive warfare - although one Admiral Vincent Gallery in his book U-505 said that this was a stupid charge as in his words "I don't see how any sane admiral or general could not wage aggressive war."

A more telling charge was "crimes against humanity." Mussolini aided Hitler in the Holocaust willingly turning over to the Nazis Italian Jews for deportation to the death camps. He also committed a number of crimes against humanity against his own people in the brutal behavior of his blackshirts.

He would be charged over crimes against humanity and aggressive expansionism. Probably he would get death penalty by hanging. Another thing is that even get Mussolini front of judges and get hanged or would he ratherly commit suicide.

Tried and found guilty of crimes against peace and waging a war of aggression. I actually think he might skate on the crimes against humanity charges by arguing that he was coerced by Nazi Germany into cooperation with the deportation of Italian Jews. There's ample evidence that Mussolini regarded Nazi racism as pseudoscientific nonsense and harbored no racial hatred towards Jews.

It all depends wether or not Mussolini is tried before an International Tribunal or Italian courts, if it was Italian courts the charges would include corruption and malfeasance in office along with the other charges mentioned.
If he was tried by an International Tribunal then basically it is the same charges as the Nuremberg and Tokyo Tribunals.

I feel bad for the moose. Guy actually opposed Hitler until France and England proved to be spineless. He then was set and it became too late, and then he got stupid.

Actually his testimony would probably be very damaging to the UK and France imho. I was against Hitler and even threatened to mobilize against him taking Austria, but you guys caved. How am I the bad Guy?

What would Mussolini have been convicted of if he survived WW2 and was captured by the Allies?

Consistent with the Nuremburg War Crimes Trial, the indictments would have been:

1. Participation in a common plan or conspiracy for the accomplishment of a crime against peace.

2. Planning, initiating and waging wars of aggression and other crimes against peace.

3. War Crimes.
