The third side of the American Civil War
How can there be a third state fighting against the union and at the same time against the confederates (this state can not be ally of the confederates or mexico)
 
Up here in Minnesota there was conflict with the Dakota in the later half of 1862.

Edit: Forgot, it's called the "Dakota war of 1862" or just "Dakota war"

I think to get the significant 3rd side, you need to go back to alternative Rebellions of 1837. Some sort of Canadian-background US part later pursuing independence can be imaged if US would fight against British instead of supporting the quelling of rebellion.
 
Bear Flag Revolt succeeds in occupying all of Alta California in 1846, actually is independent for two years or so but get brutally subjugated by the US after the Mexican-American War. Gold Rush happens still, but now California wants to be as far from evil Washington's power as possible.

I know you said no mexico but the only way I can get this to work is include mexico in order to drag in that 3rd nation that is not mexico (so a fourth nation I guess...)

In OTL Seward and Lincoln sent a commission to the Confederates proposing a cease fife just long enough for both sides to invade Mexico to kick out the French. The South was actually in favor of it but I forget right now what lead to it not going anywhere, I have a feeling some battle happened and one side figured it didn't need to consider a cease fire. So,in ATL the two do go through with it, they make sure to declare their beef isn't with Mexico per se; but with French interference and the puppet regime. War happens with France, France loses, Mexico becomes a republic. What happens after that...in would think either the South rejoins or the North just let's them go, neither would want to go back to fighting I would think. The South would be worn out and the north led by NY city would be wanting an end to conscription.
 
considering there was already seperation feeling in california especially with growing success and wealth a joint republic of california and texas would be cool to see.

The original "republic" along with the original statehood proposal was for California to be everything west from the Rio Grande to the Pacifi, with the entire Rio Grande being the Republic and state off Texas border. Two giant states out of the territories seized from Mexico. Imagine if those were the borders of two nations...
