The new King of Scotland in 1712

You are understanding the laws perfectly correctly.

That's what I thought. So England would have an opportunity to negotiate the repeal of the Act of Security and the expectation of the Hanoverian succession, probably in exchange for some law guaranteeing Scotland's continued independence. However, if that fails then there is a pretty good chance that the Jacobites would try to enthrone James VIII after Anne's death. Really it would all depend on how the Anglo-Scottish negotiations go and what Louis XIV is willing to do at Utrecht.

You still seem to be clinging on to the belief that at this point the Jacobites would settle for Scotland, even if Scotland were on the table at the Treaty of Utrecht. They would never do so and everyone would realise this. The Jacobites were really all or nothing at this stage. I actually had this happen and a Jacobite restoration in a timeline based on the 1745 rebellion a while ago, but even then it was very implausible if I am being honest.

If the Old Pretender was proclaimed King at the Tollcross all that would happen would be that England would invade Scotland and justifiably so. The Jacobites were a risk to English national security. If the English didn't invade, the Jacobites would.

You could even see a Scottish Civil War in the extremely implausible scenario where the Jacobites do not invade. Why would the Scottish nobles take such a risk when the Jacobites in the nobility would be in a minority?

If you really want the Old Pretender put on the throne(and I do not have a clue why), you would need him on the throne of England as well. Anything less just will not happen and as a result, the only option would be the other candidates put forward.

The other candidates would by one hundred miles be better for Scotland.

In all probability you would see the eleven year old James, Duke of Hamilton crowned King James VIII in 1714. You would also see Scotland becoming an English satelite state in much the same manner as it was during the reign of James VI before he became King of England. His age would also give the Scottish Parliament the added advantage of being able to control the King.

You have a choice of unity and power or division and less power.
