Roe v Wade overturned

The Robert Bork timeline reminded me of this TL i wrote for Different Worlds on August 4, 2007

1982:
Lewis Powel decides to retire after 10 years on the Supreme Court.

Vice President Bush casts the tie breaking vote to confirm Robert Bork as Powel´s replacement.

1992:
Bork´s opinion in the PLANNED PARENTHOOD OF SOUTHEASTERN PA. v. CASEY case declares there is no constitutional right to have an abortion. Justices White, Scalia and Thomas as well as Chief Justice Rhenquist sign Bork´s opinion. Justice Souter and O Conner write concurring opinions upholding the Pennsylvania law but reaffirming Row vs. Wade. Justice Blackmun reads his angry dissent from the bench. Justice Stevens signs on the Blackmun´s view.

Democratic candidates for state legislature use protecting a women´s right to choose a winning issue.

Later 1990s:
No state outlaws abortion, most however adapt restrictions such as bans on partial birth abortions and requiring parental consent for minors.

2007:

Abortion has little effect on national politics, as abortion is a state matter.
 
It get Bork on the Court I suppose i could have had Reagan nominate him instead of Scaila in 1986. In 1987, 58 Senators voted against Bork. In 1986, 8 Republicans were defeated or retired. Only one, Chase of Maryland I think would have voted against Bork.

Oooh, Flame bait thread.

That said, I doubt that no states would go about banning abortion, or that the issue would just vanish from National Politics. Its hard to make the genie go back in the bottle once its out.

Also, any other major court case changes in your timeline, Bork would probably have an effect on other rulings no?
 
Yeah, some states are gonna ban abortions. I'm looking at some of the Midwest and maybe some of the Southwest and South. I think its naive to think that at least some of the Conservative states will not go about banning it.

And in those states that do (and pardon this if it is graphic), you'll have the back alley abortions and coat hanger abortions, all dangerous to the mother, as you had in the era before abortion was allowed.

Utah is th only state I could actually see banning it. The South has too many problems with teenage pregnancy to actually try to push this through.
 
Yes I realize that it was naive to assume that abortion would disapear from national politics. It is an issue people care about so they would want to know how candidates for Congress and President think the issue.

And you know, that both parties would support overturning the ruling Paul.

An overturn of Roe v Wade will just call in turn for an overturn of Planned Parenthood vs Casey. And being as major factions in both the Democrats and the Republicans would not like the idea of no federal move on abortion, there would be a new ruling.

Again though is there anything more to this timeline or is it just a hop skip and jump?
 
Most likely result is a few states ban abortion nearly completely, probably only with exceptions for rape and health of the mother.
Most states adopt a European-like approach---no restrictions 1st trimester, heavy restrictions 2nd trimester, ban 3rd, particularly as the age of viable premature birth creeps further and further back (I believe the record is in the 5th month now).
A few states have mostly unrestricted abortion, with possibly some minor restrictions in the 3rd trimester.

You're likely to see a major political realignment as a result of this at the national level, because a lot of groups that hate each other's guts are not longer forced into coalition because of this single issue. You're also likely to see the religious right largely demobilize as a political force as this issue is their oxygen.
