Legal status of communist symbols in a surviving Soviet Union TL?

OTL many former communist nations have placed banns on communist and Soviet symbols in public places. I was wondering what would be the legal status of communist and Soviet symbols in a world where the Soviet Union survived until the present day. Would they be able to ban symbols from an existing state? For the sake of the argument the surviving Soviet Union doesn't have the Baltic states and looks a lot like the OTL Russian Federation just with more territory.

I'm not sure I understand the scenario here. Do you mean the Soviet Union survives as an officially Communist nation? If so, I don't see why there would be any question about the legality of their symbols, eg. the Hammer And Sickle and the Red Star would be just as legal as they are IOTL China, since the state will still be Communist.

If you mean Russia as metropolitan for a larger empire(lack of a better word), but with Communism offically gone as the ruling ideology, well, Communism is no longer the ideology of OTL Russia, but the Hammer And Sickle and Red Star are legal there, so probably would also be so in your alternate reality. Unless the political power of the more anti-Communist regions is strong enough to pressure Moscow into banning the symbols nationwide, but that might be a pretty tall order, like the southern states of the USA having the power to convince Washington to ban The Battle Hymn Of The Republic from being played at political events across the whole country.

So, my guess: No, the symbols wouldn't be officially banned in a surviving de-Leninized Soviet Union, but they might be pretty unpopular in some of the ethnic peripherals, where there would be an unwritten law against using them.

No, I think what he means is will they be banned in other countries--e.g., could the east European countries, even after having thrown off Communism, ban such symbols if the USSR is still around. My answer is sure, they could do that for most purposes, while still allowing the Soviet embassy to fly the Soviet flag, etc.
 
Yes, I meant the legal status in countries of eastern Europe that are no longer under communist rule.
