Jose Fernando, Prince of Asturias, survives

What if Jose Fernando, Prince of Asturias, lives? Just to explain, Jose was the grandson of Margaret Theresa of Spain, daughter of Philip IV of Spain, full sister of Carlos II and wife of her uncle Emperor Leopold I. Jose's mother Maria Antonia married Elector Maximillian II of Bavaria. Therefore, Jose was also Prince of Bavaria. To prevent a war of succession, Carlos II agreed to name his great-nephew as his heir. France and England agreed to a partition treaty if Spain's territories. However, six-year old Jose died. What if Jose lived and became King if Spain, with Maximilian II as regent. Later, Spain and Bavaria are united under the House of Wittlesbach. How would this affect history?

I mean its been discussed to death. There's nothing more we can add. For one, I doubt Maximilian will become Regent, as Cardinal Portocarrero had been designated Regent by Carlos II and foreigners weren't exactly popular in Spain. Second, Bavaria and Spain would NOT be in a personal union. Once the Prince becomes King his father will no doubt renounce Jose Fernando's rights on his behalf, as he had, what three brothers? Plus I wonder if the Wittelsbach would be able to change anything in the Empire? After all the Nueva Planta decrees were only possible thanks to the Succession war. If that doesn't happen you can be sure that there will be a revolt or a civil war.

There's also the question of whether or not the partition treaty would be respected. After all, Spain never acknowledged the treaties and OTL Carlos II left the entire Spanish Empire to Philip V. So chances are the same thing will happen TTL. Whether or not France, Austria and the Maritime powers will try to enforce the treaties is anyones guess.
 
@ Emperor Constantine: a personal union between Bavaria and Spain might have been possible, especially given examples such as Great Britain & Hanover and Poland-Lithuania & Saxony; however it IMHO will be prevented by a settlement.

Yes but both of these unions were close together or connected by water. Bavaria and Spain had neither of these.
