ALTERNATE AMERIWANK CONSTITUTION

Hello AH.com

Well, just in late December, I've made my own version of trying the most plausible largest territorial Ameriwank that could be made (but I'm still pretty much conservative on how big it could be) in this TL "The Cliche called Ameriwank"

Well, the POD is pretty much in 1774. But I'm on the opinion that even after independence in 1783, the Constitutional Convention would probably still meet around 1786 to 1787 isn't it? The country still needs to get to that "AOC moment" to finally realize that the Articles of Confederation must be revised. So here it is. I'm planning on creating this kind of an alternate US Constitution. Is this quite plausible?

The plan is pretty much making it appear that the original Articles of Confederation is just being amended, though DRASTICALLY amended. So amended Articles of Confederation will establish:

Confederation Congress- will remain a unicameral body, except that it is divided into two groups of Congressmen: senators, representing the states, and people's representatives, representing the people. Senators and representatives meet together and attend sessions together, given that they're part of a same body, but they voted separately. So a bill being deliberated on the general floor of Congress must be passed with both the "Senate" and the "Representative Group" agreeing to its provisions. There are three senators per state, and the voting process among senators is BY STATE, not by individual as it is in the representative group. The senator group pretty much have the same functions as OTL's Senate.

President of Congress- elected by the Congress for a four year term, with the Senate and the Representative Group voting separately. So there must be a consensus on who must be the President between the senators and the representatives. The President of Congress is pretty much a presiding officer in Congressional sessions, but it would also act from now on as the head of state; being commander-in-chief of armed forces and chief diplomatic official.

Executive President- This would be OTL's President, except without the military and diplomatic powers. He/She was elected in the same way as OTL, with a twist. Each "region" (consisting of different states to be determined by Congress, though by the convention at first) will have a chance of getting the presidency, with the candidates for in that specific election only coming from that region. The Executive President is also acting just as the head of a "collective executive", which is the Cabinet, with its composition to be determined by Congress. And based on the convention, by draw lots whatever, New England gets the first shot at the presidency.

Supreme Court- Pretty much like OTL.

In the end, I'm thinking of having George Washington as the President of Congress and John Adams as the first Executive President of the United States. Hahaha.

Tell me your thoughts. :)

Am I to understand that all 3 senators have to cast their vote the same way? How is this decided? Do they do a seperate 2/3 vote to decide how the 3 senate votes are cast?

Not sure how hot on the idea of congress being able to declare and conduct war without the president being elected by the people, although I suppose if the congress is more responsive/accountable to the people it wouldn't be so bad. That's a big if however.

Since it's you, I have to ask: Are you talking Ameriwank Ameriwank or generic overall Ameriwank?

I was building an Ameriwank Ameriwank constitution based on "The (Improved) Constitution of the (Truly) United States)", with heavy editing to displace anachronisms and make it fit in-universe.

The problem I have with trying to imagine a realistic constitution-wank for the US is figuring out which things the founding fathers could actually have known that would be good for the US given the ways population/territory/world events/social issues, etm., would go, and which things are only able to be known about in hindsight. Of the things only available in hindsight, which of them would be changed for better or worse given the nature of the Ameriwank in question?

The answer I lean towards is a fairly flexible constitution that is rock solid on some issues but flexible on others. Which is which is hard to say... It's all in theory at the moment.

Depends on the state. Given that it's 3 senators, the intention is to allow a state to not abstain from voting by using a 2-1 vote in terms of allowing the states to vote yes or no in bills rather than abstain from voting since they could not achieve consensus. Eventually, all of the states adopted a majoritarian system for intra state voting among senators.

And in terms of the Congress having powers to declare and conduct war, We're still not yet in the Jacksonian democracy mindset for the people to cry foul over the idea that the President is Congressionally elected. Besides, they are represented in that election by their senators and representatives right? No one cried foul over the Electoral College idea of OTL since they cannot directly influence presidential outcomes right? The newly hatched concept of representative democracy would be fine as an argument in this period.

Can you give me the link please?

I'm talking about a generic overall Ameriwank I think. And I want a unique Ameriwank constitution within plausible boundaries at least.

Yes. I understand. OTL's Constitutional Convention pretty much designed the presidency with Washington in mind but what about someone taught that the powers of the President being designed is too much? That's where the Congressional presidency and the executive presidency will enter. And the idea is pretty much to appear that the Articles was just amended, though DRASTICALLY amended, not revised. That's what entered James Madison's mind in TTL.

I think the political system is pretty much flexible for me. If there are things which would be changed, it might be almost the same things as OTL.
