AHC and WI: Civil Rights Act of 1875 Upheld

What is the latest PoD where this law is not overturned by the Supreme Court, and what would be the effects?

CONSOLIDATION: My two-cents: I can see Garfield surviving as a good PoD, wherein he proceeds to seek enforcement of the law enough that the three justices he appoints feel inclined (out of loyalty if nothing else) to uphold it; sway one more justice, and it's a majority...

Are SU justices usually that "loyal" to the man who appointed them? After all, from 1881 to 1888 all the Justices were Republican appointees, yet that didn't stop them throwing out Reconstructionist laws. In 1883 there was only a single dissenter, Justice Harlan.

Incidentally, given the general northern weariness with everything to do with Reconstruction, doesn't a strong Civil Rights policy pretty well ensure that Garfield will be defeated for re-election?
