AH Challenge/Discussion:The US as a Member of the International Criminal Court

The US voted against the Rome Statute, and still hasn't joined the International Criminal Court. Some even go as far as to say it would go against the constitution for the US to join it, and to join you would need to amend it. Over the past decade or so the US has had what I would call a rough relationship with the court. Clinton seemed open to the idea, while the Bush Administartion was hostile towards it, while the Obama Adminstration has tried to co-operate with it, but has no plans to become a member.

So, my questions are...

1) With a POD no earlier than the 90's, how do you get the US to become an active member of the International Criminal Court?

and...

2) What would the implications of this be for the US and the rest of the world? For example, could Osama Bin Laden have been put on trial at the ICC if the US was a member?
