WI: People killed in OJ Simpson Vegas Robbery

What if OJ Simpson and his accomplices had shot and killed some of the people at the hotel? would they get the death penalty? Would Simpson plead guilty?
 
The State of Nevada still has capital punishment by lethal Injection,
do those problems they looking into option of Gas Chamber. for moment the executions are halted.

Question is, will OJ Simpson sentence to capital punishment, because he organize the deathly heist or just get the Shooter capital punishment ?
off course if OJ Simpson shoot, he could get capital punishment
 
Legally, it's felony murder, even if the death is accidental but caused by one of the perpetrators. If your accomplice kills someone in the act of y'all committing the crime, you did it just as much as he did. He'd be quite eligible for the needle in this case.
 
Felony murder so he's done, although given the feeling that Nevada was convicting to make up for the original trial they may decide to take the death penalty off the table. On the other hand in this TL he's accused of murder so not only would he likely be put away on the facts (as opposed to "he got away with it 15 years ago, now he's going down,") but people will be even more certain he did it the first time round.
 
What kind of defense would his attorneys put on in this timeline?

At most "Mr Simpson went there to recover his property, he was not aware his friends were armed and deeply regrets what happened. He is prepared to plead to the lesser charge of conspiracy to rob and involuntary manslaughter. He is prepared to testify against his companions". In other words "We're f**ked separate the trials and give us a way to save our client from the death penalty".

In OTL there was a lot less ambiguity about the robbery trial than there was about the murder (which was of course created by the defense team). Also its about a year after "If I did it" so "Prior bad acts" will be on the jury's mind no matter what happens. Probably the defense will use this at appeal on the grounds of right to fair trial, and to create enough doubt if he is convicted of murder to skirt the needle. Either way I suspect he'll probably get at least thirty years but with a much longer term before parole, more likely they just throw away the key.
